Terms & Conditions

These Terms and Conditions ("Terms") govern your use of sagingelephant.com and any purchase you make from Sohi Holdings LLC d/b/a Saging Elephant ("Saging Elephant," "we," "us" or "our").

 

1. Acceptance of These Terms

By using this site, creating an account or placing an order, you agree to these Terms and to our Shipping Policy, Refund and Return Policy, Privacy Policy and Cookie Policy, which are part of these Terms. If you do not agree, please do not use the site.

 

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase or create an account on this site.

 

3. Site and Account Use

You are responsible for keeping your account login details confidential and for all activity under your account. Provide accurate information and keep it up to date. Notify us at sagingelephant@gmail.com if you believe your account has been used without your permission. We may suspend or close accounts that violate these Terms.

 

4. Product Information

We try to describe and display products accurately. Colors, sizes, packaging and appearance may vary slightly from images, and suppliers may update packaging or formulations. Always read product labels, ingredient lists and directions before use. If you have allergies, sensitivities or medical conditions, review the ingredients and consult a qualified professional before using a product.

 

5. Pricing and Order Acceptance

All prices are shown in U.S. dollars (USD). Prices and availability may change without notice. Placing an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not guarantee fulfillment. We accept a physical-product order when fulfillment begins and a digital-product order when access is activated. We may refuse or cancel an order in certain cases, for example if:

  • a product is unavailable

  • there is a pricing or listing error

  • we suspect fraud

  • we cannot fulfill the order

If we cancel an order after payment, we will refund the amount paid to your original payment method. Sales tax, where applicable, is calculated at checkout.

 

6. Physical Fulfillment

Physical products are fulfilled by third-party suppliers and are currently shipped within the United States only. Shipping, delivery and order-issue procedures are described in our Shipping Policy. Refund and return terms are described in our Refund and Return Policy.

 

7. Digital Products and License

When you purchase a digital product, such as What Goes First?, you receive a limited, personal, non-exclusive and non-transferable license to access and use the included content for your own personal, non-commercial use. This license remains effective while access is available under the applicable plan. We may suspend or terminate access if you materially violate these Terms, share or resell access, redistribute the content, engage in fraud or misuse the service, subject to applicable law.

You may not:

  • share, resell, sublicense, publish or distribute the content, the downloadable guides or your access

  • share your account or Access Hub login with others

  • copy, adapt or repackage the content into other products or services

Digital purchases are final and non-refundable except where required by applicable law.

 

8. What Goes First?

What Goes First? is a one-time $19 purchase with no recurring charges. It includes:

  • Access to the What Goes First? custom GPT

  • Four downloadable guides

  • Access to the private What Goes First? Access Hub

Access: Access remains active under the Founding Access plan unless the plan is canceled or discontinued. A site member account is required to purchase and access What Goes First?

Technical requirements: A free ChatGPT account is required to use the What Goes First? GPT. ChatGPT is a third-party service operated by OpenAI and is subject to OpenAI's own terms and privacy policy. Usage limits may vary by ChatGPT plan. We do not control ChatGPT's availability, features or limits.

Nature of the guidance: What Goes First? provides personal-care sequencing and product-use guidance. It does not diagnose any condition and does not replace medical or emergency care.

 

9. Intellectual Property

All content on this site, including text, graphics, images, logos, guides, the What Goes First? materials and the overall design, is owned by or licensed to Sohi Holdings LLC and is protected by intellectual-property laws. You may not copy, reproduce, distribute or create derivative works from it without our written permission, except as allowed by the license in Section 7.

 

10. Prohibited Conduct

You agree not to:

  • use the site for any unlawful purpose

  • attempt to gain unauthorized access to the site, other accounts or our systems

  • interfere with the site's security or operation

  • upload malicious code

  • scrape or harvest data

  • submit false orders or fraudulent payments

  • misuse our content in violation of these Terms

 

11. Health and Wellness Disclaimer

Our products and content are intended for general personal-care and lifestyle purposes. They are not intended to diagnose, treat, cure or prevent any disease, and they are not a substitute for advice from a qualified healthcare professional. If you are pregnant, nursing, have a medical condition or take medication, consult a healthcare professional before using any product. If you experience irritation or a reaction, stop use. In an emergency, contact emergency services.

 

12. Third-Party Services and Links

The site uses and links to third-party services, including payment providers, fulfillment partners, ChatGPT, Instagram and TikTok. We are not responsible for third-party services, content, terms or privacy practices. Your use of those services is governed by their own terms.

 

13. Disclaimer of Warranties

To the fullest extent permitted by law, the site, its content and our digital products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site or any digital product will be uninterrupted, error-free or always available. Nothing in these Terms excludes any warranty that cannot be excluded under applicable law.

 

14. Limitation of Liability

To the fullest extent permitted by law, Saging Elephant and Sohi Holdings LLC will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products. Our total liability for any claim related to a purchase will not exceed the amount you paid for that purchase. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

 

15. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules.

 

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the site after an update means you accept the updated Terms. Purchases are governed by the Terms in effect when the order was placed.
